INTRODUCTION

These Terms and Conditions ('Terms') regulate the use of the Petly mobile application ('the App'), owned and managed by The Pet Barber (Pty) Ltd ('the Company'). By accessing or using the App, users agree to be legally bound by these Terms.

NATURE OF SERVICES

The App serves exclusively as a digital platform that facilitates the scheduling of pet care and related services provided by independent third-party service providers ('Service Providers'). The Company does not provide pet care and related services and accepts no responsibility for the conduct, performance, or outcomes of such services.

INDEPENDENT CONTRACTOR DISCLAIMER

Service Providers operate as independent contractors and are not employees, agents, or representatives of the Company. The Company does not oversee, manage, or control the actions, omissions, or service quality of Service Providers and bears no liability in this regard.

USER ACKNOWLEDGEMENT AND ASSUMPTION OF RISK

Users acknowledge that pet care and related services may involve inherent risks. All services are undertaken entirely at the user's own risk. The Company shall not be liable for injuries, allergic reactions, illnesses, death, damages, or losses arising from any grooming activity or Service Provider conduct. Users are responsible for enquiring directly with Service Providers regarding products, tools, and methods used.

USER RESPONSIBILITIES

Users agree to:

  • Provide complete and accurate information regarding their pets, including medical conditions, allergies, behavioural concerns, and vaccination history.
  • Ensure that their pets are healthy and suitable for grooming.
  • Comply with all booking, payment, and cancellation requirements.

BOOKINGS, CANCELLATIONS, AND REFUNDS

Bookings are confirmed only once successfully submitted and accepted through the App. Users must comply with the cancellation and refund policies of the applicable Service Provider. The Company does not process refunds but may assist in facilitating communication.

LIMITATION OF LIABILITY

To the fullest extent permitted by South African law, the Company disclaims all liability for:

  • Negligence, errors, omissions, or misconduct by Service Providers
  • Loss, injury, or death of pets
  • Damage to user property
  • Dissatisfaction with services rendered
  • Delays, interruptions, or cancellations

ACCEPTANCE OF TERMS

By selecting 'I AGREE' or using the App, users confirm their acceptance of these Terms.
